When we say “We” “The Franchise Institute” “TFI”,”US” and “our service” we are referring to The Franchise Institute Pty Ltd and its respective products and services.
References to “you” “your” “customer” “client” refer to you, and your agents. These Terms and Conditions can change at any time. It is important that you check back here regularly. Your continued use of this website implies acceptance of any subsequent revisions. The Franchise Institutes liability is limited to the amount paid by the customer to The Franchise Institute for work undertaken.
The Franchise For Success Program License Agreement: The franchise Institute user license agreement is a legal agreement between you (either an individual or single entity) and The Franchise Institute, for the Franchise For Success Program. The Franchise for Success Program includes software, mentoring and customised legal franchise documents. By installing, copying or otherwise using the Franchise For Success Program you are bound by the terns below:
1. The Franchise For Success Program (which includes software) is protected by copyright laws. The software program is licensed not sold. Titles and copyright of the Franchise For Success Program (including images, photographs video, audio, music, text and accompanying printed materials) are owned by The Franchise Institute.
2. After installation of the software you may keep the original media on which the software was provided, solely for the purpose of archiving or re installing the software on your computer, but not on any other computer. You may not copy the printed materials or software product.
3. This software is built with an automatic security device which links it to the serial number of your computer’s hard disc, this occurs at the time of registration of the product. This should be sufficient evidence to prosecute in most cases should it be determined that you have unlawfully used or allowed unlawful usage of the software product.
4. If you illegally copy the Franchise For Success Program, do not have an appropriate license or have obtained access in an unauthorised manner you will be liable for prosecution.
Payment Terms: Payment for our services are made over a 6 month period. With 6 equal monthly instalments. The Franchise Institute and you may agree mutually to increase or decrease your monthly spend during by extending or shortening your contract period. However any changes need to be made in writing and agreed by both parties.
Franchising payments will be processed on the date indicated on your tax invoice. If paying by credit card a valid credit card must be in place for this payment. If you supply credit card details, you give us authorisation to automatically debit your credit card in relation to all amounts owed by you to us for provision of services. American Express payments attract a 3% surcharge.
If the monthly payment becomes overdue by more than 30 days we will put our services on hold until your account is brought up to date. If the monthly payment becomes overdue by more than 90 days we will send your account to a debt collection agency. You will then be liable for any fees incurred in the recouping of the fees charged by the agency.
Cancellation of our services: We schedule resources and undertake work on the certainty that you will remain a customer for your entire contracted period. Cancellation of the franchising process within the contract period is possible but will incur a 20% fee of the balance owing.
Your privacy: Your privacy is important to us. We will never sell, lease or distribute your contact details to any 3rd party. We will only reveal data pertaining to your account if compelled to do so by law.
Liability: We will not be held liable for any action or inaction relating to our service. We offer a quality service at highly competitive rates.
Disclaimer of warranties: The Franchise Institute does not give any warranty in respect of our services other than as is implied by law.
Severability: If a clause or part of a clause is read in a way that makes it illegal, unenforceable or invalid, but can also be read in a way that makes it legal, enforceable and valid, it must be read in the latter way. If any clause or part of a clause is illegal, unenforceable or invalid, that clause or part thereof is to be treated as removed from this document, but the rest of this document is not affected.
Jurisdiction: This website is governed by the laws of the state of New South Wales, Australia. Any dispute arising from the use of this website will be settled in this jurisdiction.
